Our terms and conditions for using OSHCGURU services

1. Acceptance of These Terms

By accessing oshcguru.com ("Site") or using any products or services offered through the Site ("Services"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not accept these Terms, do not use the Site.

2. Who We Are

OSHC GURU is a trading name of Clearway Design LLC, a Texas limited liability company ("OSHC GURU," "we," "us," "our"). We are not an insurance company or insurance broker. We operate an online comparison platform that allows overseas students to review and purchase Overseas Student Health Cover (OSHC) from insurers approved under the Australian Government's Deed for the Provision of OSHC.

3. Eligibility & Use of the Site

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form legally binding contracts to use the Services. You agree not to use the Site for any unlawful purpose or in any way that may harm OSHC GURU, its partners, or other users.

4. Our Services & Disclaimers

  1. Information Only. All content is provided for general information and comparison purposes; it does not constitute financial, medical, or immigration advice. Always verify policy details directly with the insurer and seek professional advice where appropriate.
  2. No Guarantee of Visa Approval. Holding OSHC through any insurer listed on the Site does not guarantee that your visa will be granted or remain valid.
  3. Policy & Price Information. We endeavour to keep premiums, benefits, and features accurate and current, but we do not warrant that information is complete, error-free, or up to date. Insurers may change pricing or coverage at any time without notice to us.
  4. Commission Disclosure. OSHC GURU may receive commissions from insurers when you purchase a policy through our Site. This does not affect the price you pay.

5. Lowest-Price Guarantee

We aim to offer the lowest publicly available price for any identical OSHC policy on the day you purchase through OSHC GURU.

How it works:

  • If you find a lower advertised premium for the same policy (same insurer, level of cover, visa subclass, policy start/end dates, and number of dependants) within 48 hours of purchase, email help@oshcguru.com with written proof (e.g., dated screenshot or official quote).
  • We will review the evidence within 5 business days. If validated, we will refund the difference to your original payment method or apply a credit, at our discretion.
  • Offers containing coupon codes, cash-back rebates, group discounts, agent-only pricing, or pricing errors are excluded.
  • The guarantee applies to the base premium only and excludes credit-card surcharges, government fees, or optional add-ons.

6. User Accounts & Security

You may need to create an account to purchase a policy. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

7. Payments & Refunds

Payments are processed in Australian dollars unless stated otherwise. Premiums and any credit-card or foreign-exchange fees are non-refundable except:

  1. where mandated by the insurer's own refund rules; or
  2. where required under Australian consumer law; or
  3. under our Lowest-Price Guarantee (Section 5).

8. Intellectual Property

All Site content, trademarks, graphics, and software are the property of OSHC GURU or its licensors. You may view, download, and print materials for personal, non-commercial use only. No other use is permitted without prior written consent.

9. Third-Party Links

The Site may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of these sites and disclaim all liability arising from your use of them.

10. No Warranties

The Services are provided "as is" and "as available." OSHC GURU disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, OSHC GURU, its directors, employees, and agents will not be liable for any indirect, special, incidental, or consequential losses arising out of or related to your use of the Site or Services, including lost profits, data, goodwill, or business interruption, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising under these Terms will not exceed USD 100 or the total premiums you paid through the Site in the preceding twelve months, whichever is greater.

12. Indemnity

You agree to indemnify and hold harmless OSHC GURU from and against any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Site, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any breach of these Terms or for operational or security reasons. Sections 8–15 survive termination.

14. Changes to These Terms

We may modify these Terms at any time. Updated versions will be posted on this page with the "Last updated" date revised. Continued use of the Site after changes constitutes acceptance of the new Terms.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms shall be resolved exclusively in the state or federal courts located in Travis County, Texas. Before commencing litigation, you agree to attempt to resolve the dispute informally with us for at least 30 days.
